Foreclosure is a legal proceeding taken by a mortgage holder to take possession of property. The legal proceeding begins with a Foreclosure complaint. The mortgage company files a complaint with the court.

How does it Work?

In Illinois, the foreclosure process is governed by the Illinois Mortgage Foreclosure Act (IMFA). The process begins when the Plaintiff (the mortgage Company) files a complaint naming the homeowner the defendant. On average, the process takes about nine months. Generally, the process follows this outline:

  • Service

  • Court date

  • Judgment

  • Sale
